TotalTrade is backtesting, journaling and analytics software. It is not a broker, does not receive, transmit or execute orders, does not hold or manage funds, and does not provide personalised investment advice under Italian Legislative Decree 58/1998 (TUF) or equivalent law.

1. Information only

Information, simulations, statistics, examples, opinions and educational materials are provided for general information only. They are not an offer, solicitation, recommendation or instruction to buy, sell or hold any financial instrument. Consider obtaining independent advice from a qualified professional before making an investment decision.

2. Hypothetical results and external data

Backtests and hypothetical results are not actual trades and do not guarantee future results. They may not fully reflect liquidity, spreads, commissions, slippage, latency, gaps, rejected orders, data quality or emotions; hindsight and overfitting can reduce reliability. These cautions reflect principles also documented in CFTC Rule 4.41, whose formal applicability depends on jurisdiction and status. External data may be delayed, revised or inaccurate.

3. User responsibility

You are solely responsible for your trading and investment decisions, the strategies you select, the parameters you enter and the consequences of using platform outputs. No tool can remove market risk or guarantee profitability.

4. Brokers and prop firms

References to any broker or proprietary trading firm are informational and do not imply endorsement, partnership or operational control. TotalTrade is not responsible for a provider’s closure, insolvency, non-payment, restrictions, conduct or changes in commercial terms. Carry out your own legal, regulatory and financial checks.

5. Video, live and community content

Videos, live streams, Discord messages, Community posts and other materials published through official channels are educational and informational. They do not constitute personalised advice, trade signals or an invitation to invest. Statements by users or independent contributors do not necessarily represent TotalTrade.

6. Nature of the Service and external trading

TotalTrade is a simulation, backtesting and analytics environment. It does not enable users to buy, sell or hold financial instruments, does not accept deposits for trading and does not provide direct market access. Using TotalTrade does not, by itself, expose a user to market losses. Financial risk arises only if a user independently decides to trade through a broker, proprietary trading firm or another third party, and remains governed by that provider's terms and warnings. ESMA's standardised CFD warnings apply to firms that market, distribute or sell CFDs; TotalTrade does not perform those activities and therefore has no retail-loss percentage attributable to TotalTrade users.

7. Limitation of responsibility

To the fullest extent permitted by law, TotalTrade and the site owner are not responsible for loss or damage arising from reliance on platform information, external links, third-party data or user decisions. Mandatory liability and consumer protections remain unaffected.

8. Relationship with the Terms and contact

The reference framework includes ESMA's CFD product-intervention measures and the U.S. CFTC principles on hypothetical results, including Rule 4.41. These references clarify the scope of the warnings and do not imply that TotalTrade is an intermediary, a CFD provider or supervised by ESMA or the CFTC. This Disclaimer supplements the Terms.
